General Terms and Conditions of Sale (GTC) – POP Factory Concept SRL

2. Purpose

These General Terms and Conditions of Sale (GTC) define the rights and obligations between POP Factory Concept SRL and any person placing an order via the webshop.

Any order implies unconditional acceptance of these GTC.

3. Products and services

POP Factory Concept SRL offers:

• Food products (sandwich shop)
• Catering services
• Products prepared on demand or customised

Descriptions are provided with care.

⚠️ Products may vary according to availability and season.

4. Allergens and food safety

Information regarding allergens is available upon request or at the point of sale.

The customer is required to inform themselves before any consumption.

POP Factory Concept SRL disclaims any responsibility in the event of an allergic reaction related to a failure to consult this information.

5. Prices

Prices are indicated in euros (€), all taxes included (VAT).

POP Factory Concept SRL reserves the right to change its prices at any time.

The applicable price is that displayed at the time of order confirmation.

6. Order

Any order is firm and final upon payment confirmation.

A confirmation email is sent for informational purposes.

POP Factory Concept SRL cannot be held responsible in case of non-receipt of this email.

POP Factory Concept SRL reserves the right to refuse or cancel any order in case of:

• suspicion of fraud
• previous dispute
• manifest error

7. Payment

Payment is due in full (100%) at the time of order.

No order will be prepared or validated without full payment received.

Payments are secured via the providers offered on the webshop.

In the absence of full payment, the order is automatically cancelled.

B2C: The first reminder sent to an individual is mandatory free of charge.

In case of total or partial non-payment of an invoice after the first reminder, the amount of the invoice will, after a formal notice that remains without effect, be automatically increased by a flat-rate compensation of 12% of the total amount of the invoice, with a minimum of 50 euros, as a penalty clause for administrative costs.

B2B : En cas de non-paiement total ou partiel d'une facture à son échéance, le montant de la facture sera, après mise en demeure restée sans effet, majoré de plein droit d'une indemnité forfaitaire de 12 % du montant total de la facture, avec un minimum de 50 euros, à titre de clause pénale pour frais administratifs.

8. Retrait des commandes (Aucune livraison)

Aucune livraison n’est proposée.

Les commandes doivent être retirées à :

26 Rue de la Station, 5560 Houyet, Belgique

Conditions :

• Le client est informé lorsque la commande est prête
• Le client doit respecter le jour et le créneau convenus
• Une preuve d’achat peut être demandée

Toute commande non retirée le jour prévu de sa mise à disposition, pendant les heures normales d’ouverture, sera considérée comme abandonnée.

Elle sera automatiquement annulée et ne donnera lieu à aucun remboursement, notamment pour les produits alimentaires, périssables ou préparés à la demande.

9. Commandes traiteur et acomptes

Pour les commandes traiteur nécessitant préparation spécifique ou de montant important :

• Un acompte de 50% peut être demandé à la commande
• Le solde doit être payé au plus tard [X jours] avant la date prévue

Annulation tardive

Toute annulation effectuée moins de 72 heures avant la date prévue de retrait sera considérée comme tardive.

POP Factory Concept SRL reserves the right to charge the order in full and the deposit, if applicable, remains acquired by the company.

Modification

Any request for modification must be made at least 48 hours before the scheduled date and remains subject to the acceptance of POP Factory Concept SRL.

10. Right of withdrawal

In accordance with Belgian and European law :

❌ The right of withdrawal does not apply to :

• food products
• perishable products
• customised products
• catering services

➡️ These orders are firm and non-refundable.

Exception

For non-customised non-food products :

• Deadline of 14 days from collection
• Unused product returned in original condition
• Return costs borne by the customer

11. Liability

POP Factory Concept SRL cannot be held responsible for :

• poor storage after collection
• failure to comply with consumption instructions
• inappropriate use
• allergic reactions

Food products must be consumed quickly after collection.

12. Warranties

Legal warranties apply only to non-food products.

13. Force majeure

POP Factory Concept SRL shall not be held responsible in the event of force majeure preventing the execution of orders.

14. Personal data

The data is used solely for the processing of orders.

In accordance with the GDPR, the customer has the right of access, rectification and deletion.

15. Intellectual property

All elements of the site are protected.

Any reproduction is prohibited without prior authorization.

16. Applicable law and disputes

These general terms and conditions are subject to Belgian law.

In the event of a dispute:

• an amicable solution will be preferred
• failing that, the courts of the company's registered office will have jurisdiction
